PAYMENTS

PAYMENT START DATE

Once you have placed your order, payments via Direct Debit and BPAY will start on the date you selected. Payments by Credit Card will be debited on the 15th of every month.

PAYMENTS ON PUBLIC HOLIDAYS

Your Direct Debit payment will come out the next working day. Please note that chrisco Hampers is located in Sydney, therefore we observe all NSW public holidays. If you wish to skip a payment on a public holiday, or on the day after, you will need to let us know before midday on the working day prior.

MISSED PAYMENTS

If you miss a payment we will automatically recalculate and slightly increase your future payments so that your order is fully paid by the Final Payment Date. If several payments are missed, we will reduce your order to make the remaining payments easier. We reserve the right to reduce or cancel your payments should your plan fall too far behind. We are not responsible for your bank charges if payments fail. We will charge an administration fee of $3.50 if a payment fails.

If you are unable to keep paying, we will reduce your order to the amount you have already paid, and you will still receive products and/or vouchers for Christmas. We are happy to discuss your order at any time. Simply Contact Us.

DIRECT DEBIT AUTHORITY

If you are paying by Direct Debit, you will need to complete a Direct Debit Authority to allow a payment to be automatically deducted from your bank account. By filling out the Direct Debit Request form, you are authorising chrisco Hampers to debit your payments from your chosen account. At midnight on the day you have chosen (usually your pay day), our bank debits your account electronically. It’s easy. Just fill in the form and then... relax.

STOPPING A DIRECT DEBIT PAYMENT

If you call us on 1800 830 830 by midday the working day before your payment is due we can stop a payment (i.e.: before Friday midday for a Monday payment).

HEADSTART PLAN

What is a HeadStart Plan? A HeadStart Plan allows you to make payments towards next year’s order, while giving you time to decide exactly which products you want. Once your 2017 order is fully paid, a HeadStart Plan for 2018 will automatically be created for you and your direct debit payments will continue (for the same amount as your second last payment for your 2017 order).

What if I don’t want a HeadStart Plan? If you do not want to have a HeadStart plan, you can tick the red box at the bottom of the order form or simply call us on 1800 830 830 and we can do it for you.

What will my payments be under a HeadStart Plan? We will write to you to confirm the amount and other details of your HeadStart Plan payments prior to commencing your direct debits under the HeadStart Plan.

Are my payments refundable? Payments under your HeadStart Plan are fully refundable unless and until you convert them into an order for 2018. Once payments under your HeadStart Plan are converted into an order for 2018, chrisco’s Cancellation Policy will apply to your 2018 order (see below for details, or the Terms and Conditions of Purchase on chrisco’s website: www.chrisco.com.au/ConditionsInfo.aspx). You can convert your HeadStart Plan into an order for 2018 by filling out the order from in next year’s catalogue, by giving us a call on 1800 830 830, or going online at chrisco.com.au.

What if I don’t convert my HeadStart Plan into an order? If you have not converted your HeadStart Plan into an order by 16th February 2018, chrisco will automatically place an order for you for goods of a similar value to your 2017 order (unless you tell us not to do this). Orders that are automatically placed by chrisco are fully refundable unless and until you confirm your order. Once you confirm your order, chrisco’s Cancellation Policy will apply (see below for details, or the Terms and Conditions of Purchase on chrisco’s website: www.chrisco.com.au/ConditionsInfo.aspx).

Free Gift: To give you an extra helping hand, chrisco will give a free gift with a retail value of at least $25 to customers whose HeadStart Plan is converted into an order for 2018 (Limit one free gift per customer).

Free Gifts & Incentive Offers

All orders must be fully paid to qualify for a hamper bonus gift. Bonus gifts will be shipped to the chrisco Hampers member’s address only with the hamper. HeadStart Free Gift: To give you an extra helping hand, chrisco will give a free gift with a retail value of at least $25 to customers whose HeadStart Plan is converted into an order for 2018 (Limit one free gift per customer).

Agents Program

* Your agent commission is paid in December on fully paid orders only. To qualify for the agent commission the combined value of all customer orders (excluding agent’s order) must be equal to or exceed $2,000.00. This is made up of the three customers or more total order value excluding any discounts. Excludes customers who live at the same address or have the same delivery address as their agent. 10% Agent Commission applies to Food Hamper orders only. 5% Agent Commission applies to Hamper Merchandise, Home& Living, Family Christmas Gifts and Top Up (non-food hampers) orders. 2% Agent Commission applies to Vouchers, Gift Cards and Travel orders. Sorry, Apple products and your own orders are not included in bonus calculations.

Restricted Products

If you are under 18 years of age, you may not use the Site to order a film or a computer game that is classified R 18+. You (18 years of age or above) are subject to certain limited exceptions specified by law, acknowledge that it is against the law to sell or supply a restricted film or a restricted game to, or obtain a restricted film or a restricted game on behalf of, a person under the age of 15 years (for a restricted film or a restricted game that is classified MA 15+) and 18 years (for a film or a game that is classified as R 18+). You warrant that you are not obtaining a restricted film or a restricted game on behalf of a person that is not of the appropriate legal age referred to the above, unless you are permitted to do so by law. CANCELLATION POLICY

You may cancel your order at any time prior to the delivery of goods. If you cancel your order within 21 days of the date of your original order confirmation (Cooling Off Period), there will be no cancellation fee. After the Cooling Off Period, chrisco Hampers will charge you a cancellation fee as follows:

  • prior to 1 August: 20% of monies paid at the cancellation date (up to a maximum cancellation fee of $200)
  • after 1 August: 50% of monies paid at the cancellation date (up to a maximum cancellation fee of $500)

In certain circumstances, and in its discretion, chrisco Hampers may waive the cancellation fee. However, cancellation fees will be incurred on all personalised items if manufacturing has commenced.

PRICING & GST

Should there be a product change, an appropriate substitution, either for products or retailer gift cards, of comparable value may be made. All weekly payments are rounded up to the nearest 5 cents, excluding gift cards and vouchers. You will however, only ever pay the total amount shown All prices are inclusive of GST, tax and/or duty where applicable. Should there be any alteration in rates of GST, tax or duty, or any unforeseen product or fuel price increases, chrisco Hampers reserves the right to substitute or adjust hamper contents accordingly to cover the increase.

Packing

All hampers are carefully packed into specially designed cartons and quality checked. Our frozen hampers are packed in insulated cartons.

DELIVERY

Delivery – General

All deliveries are made from November to mid December 2017, unless stipulated otherwise. We’ll send you a delivery advice card closer to the time to advise your delivery details. If you order multiple items, you may receive your items over multiple days.

While every effort is made to deliver as advised, chrisco cannot accept any liability for delay due to the customer’s failure to complete customer obligations or any other reason beyond the control of chrisco (and/or its staff). chrisco does not accept any liability resulting from a contracted party’s failure to deliver as advised. Deliveries to islands or some remote communities may incur an onforwarding freight charge depending on the postcode (see below). Should your delivery address change, please inform chrisco immediately. If a delivery address is changed after the 25th August 2017 for orders from Christmas Hamper catalogue, Home and Living catalogues or 1st August 2017 for any  personalised merchandise, chrisco reserves the right to charge an administration fee.

Delivery - Frozen goods

Due to the nature of frozen goods, customers must be home to accept delivery on the day advised, or make arrangements with friends or neighbours to accept it for you. We recommend you put frozen products into your freezer as soon as you receive them.

Delivery - Alcohol

In accordance with liquor licensing legislation, customers who purchase hampers containing alcohol must be over the age of 18 years at the time of order. Proof of identity and age will be required.

LICENCE NUMBERS

NSW: Liquor Act 2007 - it is against the law to sell or supply alcohol to, or to obtain alcohol on behalf of, a person under the age of 18 years. Licence No. LIQP770010154.

VICTORIA: Under the Liquor Control Reform Act 1998 it is an offence: To supply alcohol to a person under the age of 18 years (Penalty exceeds $6,000). For a person under the age of 18 years to purchase or receive liquor (Penalty exceeds $500). Licence No. 36085252.

DELIVERY – PACKING & ADMINISTRATION / DELIVERY FEE

For the Home and Living  catalogue each order will incur a Packing and Administration charge of $9.95, regardless of how many items you order.

Delivery - Heavy and oversized items

Delivery costs are included except where stipulated throughout the catalogue. Some chrisco Home and Living, Family Christmas Gifts and Top Up non-food hampers will incur a delivery surcharge of $80 which will apply for each product because they are heavy or large items. Check our outer region postcode table below to see if this fee applies to you.

Delivery - Rural

Should you live in, or move to a remote rural area, we may ask you to collect your order from a local pick-up point and some very remote areas may not be within our courier delivery range. You can either check by calling us on 1800 830 830 or clicking here for the full list of effected post codes.

Delivery - Change of address

Should your delivery address change, please inform chrisco immediately. If a delivery address is changed after 25th August 2017 for orders from Christmas Hamper catalogue, Home and Living catalogue or 1st August 2017 for  personalised merchandise, chrisco reserves the right to charge an administration fee.

Delivery - Gift Card/Voucher

Gift Cards and Vouchers must be signed for on delivery. They will arrive first week of December in plenty of time for your Christmas shopping.

Delivery – Onward Forwarding Freight

Some customers live outside of our normal delivery areas and outside of our Rural Post Depot collection points. If this is the case you will be charged for onward Forwarding Freight.

Terms of use – Gift Card/Voucher

Gift Cards and Vouchers are not redeemable for cash and cannot be used to pay off in-store accounts or finance agreements. No change will be given. Once issued, if lost, stolen or destroyed they cannot be replaced or refunded. The price of your gift cards/vouchers includes a 10% fee to cover packing, postage, activation and commission. Harvey Norman Gift Cards, once issued, are valid for 24 months. Big4 Vouchers are valid for 12 months. For full Terms and Conditions, visit the respective retailer’s websites.

RETURNS

We will gladly replace items or reimburse you should a product be damaged in transit and in accordance with our legal responsibilities as a merchant (we'll make sure you are happy with your order in time for Christmas). We are unable to accept returns for other reasons such as if you have changed your mind or have made an incorrect choice about the product and no longer wish to keep it.

Product replacement

We only use brands you know and trust. This ensures they’re all top quality. And, we only deal with suppliers who have an established track record of the very highest quality. While we make every effort to supply you with your products, stock and suppliers may change. chrisco Hampers reserves the right, to make substitutions of any products. When this is necessary, we’ll ensure that they’re of equal or greater retail value.

ASSEMBLY

Assembly - Bicycles

In the interest of safety, it is recommended that you have all bicycles assembled by a suitably qualified professional. Bicycles supplied may differ in colour and/or graphics to those advertised.

Assembly – Other

Some items may require assembly and these will generally be noted in the product description and product page.

FEES

For Home and Living 2017, and all non food hampers  from Hamper Catalogues each order will incur a Packing and Administration charge of $9.95, regardless of how many items you order.

Credit Balance

We reserve the right to deduct a $25 administration fee per annum from any credit balance on an inactive account.

Other

Contract

There will be no contract between chrisco Hampers and a customer until chrisco Hampers issues a notice confirming the customer’s order. Each contract is governed by the law of the state or territory in which the customer resides except for residents of the ACT whose contracts will be governed by the law of NSW.

Errors, Omissions and Images

All efforts have been made to check for errors and omissions in typography and photography. However, errors may occur for which chrisco Hampers will not be responsible. Product images are for illustrative purposes only.

 

Conditions of Travel

Cooling Off Period : If you cancel your Travel Club Order within 21 days of your order confirmation there will be no cancellation fees charged.

The exception to this is where any part of the Travel Club Booking has been paid for and fees of any kind have been applied to the booking. 

Price Guarantee: All quotes are based on estimations, costs and exchange rates as at October 2016. The agreed quote is subject to change until deposit is reached and paid to the supplier. Price changes may occur by reasons outside of our control such as adverse currency fluctuations, fuel surcharges, taxes, charges or levies imposed by any government or their agencies.

Changes in Price and Itineraries: Quoted prices will be held for 7 days only and are then subject to change. Prices are based on costs, charges, tariffs, rates, prices, taxes and levies, exchange rates, airport charges, hotel rates and other service provider’s tariffs. In the event that such fluctuations affect the prices, which we pay for such services, we reserve the right to adjust our prices as necessary at any time. Any verbal quote given is an estimate only until deposit is reached and paid to secure your booking.

Deposit and Final Payments: A deposit per person is required at the time of booking. For all Holiday Packages a deposit of $200 per person is required and for Cruise Packages a deposit of up to $500 per person is required. However, if we are unable to confirm the agreed quote, then the deposit is fully refundable. Bookings that have no deposits paid on them are subject to cancellation without notice. For all Holiday Packages, final payment must be made 30 days prior to departure, or 100 days for all Cruises Packages. If for any reason your balance of payment is not received by the due date, we reserve the right to treat the booking as cancelled and will apply the appropriate cancellation charges.

Cancellations and Refunds: If you cancel your booking, your deposit will not be refunded and is nontransferable. If you have paid the balance of your holiday price, suppliers may also impose cancellation fees amounting to all, or part of the total holiday price. Once your holiday has commenced, you cannot cancel or obtain a refund on any component of your booking regardless of whether you use it. Holiday Packages: Cancellations 30 days or less prior to departure will result in 100% cancellation fees. Cruises: Once a Cruise Package has been fully paid, it is non-refundable and non-transferable. Where a Cruise Package has not been fully paid 100 days prior to departure, chrisco will take a $50 cancellation fee and the following supplier fees will apply:

For Royal Caribbean Cruises the supplier will charge a $100 cancellation fee plus:

   
90 – 61 Days prior to departure 25% of the total fare per passenger plus deposit
60 – 41 Days prior to departure 50% of the total fare per passenger plus deposit
40 – 25 Days prior to departure 75% of the total fare per passenger plus deposit
24 – 0 Days prior to departure 100% of the total fare per passenger plus deposit

For P&O Cruises the supplier will charge:

99 - 43 days 25% of the total fare plus deposit
42 - 15 days 50% of the total fare plus deposit
14 days or less 100% of the total fare plus deposit

Note: ‘Total Fare’ is the total amount payable to us for your bookingAmendments: Travel amendments will incur fees. If after confirmation of your booking, you wish to change your itinerary, names of travellers or departure date, chrisco will charge a $50 amendment fee plus any addition supplier fees will be quoted accordingly at the time of change.

Not Included in Holiday Price: Passport and visa fees, insurance (unless requested), laundry, phone calls, beverages, meals not detailed in the itinerary, tips to Tour Directors, motorcoach drivers and local city guides, items of a personal nature, excess baggage, expenses, fees or costs incurred in case of illness, or of refusal of entry, detention in, or expulsion or repatriation from a country or part of a country. chrisco are not liable for any expense, costs or loss incurred in relation to such matters.

Travel Insurance: Travel Insurance will be quoted at time of booking, or you have the option of arranging your own travel insurance. chrisco strongly recommends that all travellers take out travel insurance against loss of deposits through cancellation charges, baggage loss and medical expenses. chrisco makes no representations or guarantees concerning reimbursements of funds paid by you under any insurance claim. You agree not to hold chrisco responsible for any decision made by insurers, and / or by any service providers, or requirements of any overseas country or governmental authority or overseas laws and policies.

Hotel Locations and Descriptions: Please note that maps are not to scale and are provided only as a guide to locations. Hotel descriptions features are based on current International hotel guides and any facilities shown as included are subject to change at any time. Hotel room photographs may not be specific to actual room occupied.

Accommodation Ratings: Viva! Holidays: Property ratings are Viva! Holidays views and not official ratings.

Airport and Hotel Taxes: Airports and hotels have mandatory taxes in various countries. These are payable directly and will not be quoted in your estimate/booking price total.

Room Bedding Guide: Requests for particular arrangements must be made at the time of your booking such as: twin share, separate beds, or a shared bed. If this is not requested at the time of booking, additional charges may apply.

Holiday Variations: If unforeseen circumstances beyond our control require us to make necessary changes to your holiday, we reserve the right to cancel or reschedule departures and itineraries. Where it is necessary to change a hotel chrisco reserves the right to substitute accommodation of at least a similar standard.

Passports and Visas: It is your responsibility to ensure that you have a passport with a minimum of 6 months validity from the date of return. Visa entries and any permits which meet the requirements of immigration or government authorities are also the responsibility of the traveller.

Responsibility: chrisco shall be responsible to the passenger for supplying the services and accommodations described, except where such services cannot be supplied or the itinerary used is changed due to delays or other causes of whatever kind or nature beyond our control. In such circumstances, chrisco will do its best to supply comparable services, accommodations and itineraries. These terms and conditions represent the entire agreement between you and chrisco. In the absence of their own negligence, neither chrisco nor its agents or co-operating organisations shall be responsible for any cancellations or for acts of any other service providers concerned or diversions or substitution of equipment or any act, variations, postponements, omission or default whatsoever by air carriers, land carriers, cruise operators, hoteliers or hotels, transportation companies, or any other persons providing any of the services and accommodations to you including any results thereof, such as changes in services, accommodation or facilities necessitated by same. Nor shall they be liable for any loss or damage to baggage or property, or for injury, illness or death, or for any damages or claims whatsoever arising from loss, negligence of any person or its direct employee or under its exclusive control, including any act, error, omission, default, or negligence of any country, government or governmental authority, officer or employee.

Other Conditions: It is your responsibility to comply with the terms, conditions and requirements of any service provider or any country or governmental authorities, or to bear any costs or losses incurred as a consequence of you not complying with them.

Consumer Claim: Should be lodged in writing to chrisco within 30 days of return to Australia with supporting documentation. The airlines do not by virtue of their endorsement of this brochure represent themselves either as contracting with any purchaser of a holiday or as having any other legal relationship with such purchaser. Terms and Conditions are correct at time of print but are subject to change.
